class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Applicants and persons whose international protection status has been revoked have the right to lodge an administrative appeal before the Appeals Authority in accordance with Article 67 of Regulation (EU) 2024\/1348. In the case of an appeal against a transfer decision pursuant to Article 43 of Regulation (EU) 2024\/1351, the appeal shall be lodged before the competent Regional Asylum Office or Autonomous Asylum Unit having both territorial and subject-matter jurisdiction.\nThe appeal shall be signed, on pain of inadmissibility, either by the appellant or by an authorised lawyer acting on the appellant\u2019s behalf.<\/p><p>Where the appellant is detained, the appeal shall be submitted to the Head of the relevant detention facility, holding facility or centre, who shall transmit it without delay and, in any event, on the same day by electronic means to the Regional Asylum Office or Autonomous Asylum Unit that issued the contested decision.<\/p><p>Where circumstances of force majeure exist, including serious illness, severe physical disability or any other insurmountable impediment rendering personal appearance impossible for the purpose of lodging the appeal, the obligation of personal appearance shall be suspended for the duration of such circumstances.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 lawyer.<\/p><p>Alternatively, the appellant may ensure that a certificate is sent to the Appeals Authority by any appropriate means. Such certificate must be issued by the Director of the Regional Service of the Reception and Identification Service where the applicant resides and must confirm that the applicant was actually residing there on the date the certificate was requested. Alternatively, a certificate may be issued by the competent Police Authority in cases of detention, or by the Citizens\u2019 Service Centre (KEP) of the area of residence confirming the applicant\u2019s personal appearance on the date of application for the issuance of the certificate.<\/p><p>The dates referred to above may not differ by more than three (3) days from the date of the appeal hearing.<\/p><p>If the appellant neither appears in person nor through an authorised lawyer, and the above certificates are not received by the Appeals Authority, it shall be presumed that the applicant has implicitly withdrawn the appeal, which shall be rejected as unsupported, unless force majeure circumstances exist, such as serious illness, severe physical disability, or another insurmountable impediment.<\/p><p>In such cases, the applicant shall submit a relevant application specifically setting out the facts constituting force majeure or the insurmountable impediment. Such claims must be immediately substantiated by documentary evidence and the relevant certificates or attestations issued by a public authority.<\/p><p>Where the existence of force majeure or an insurmountable impediment is established, the consequences of non-appearance referred to above shall be class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The Independent Appeals Committee shall mandatorily invite the appellant to an oral hearing where:<\/p><p>(a) the appeal challenges a decision revoking international protection status; or<\/p><p>(b) issues or doubts arise concerning the completeness of the interview conducted at first instance; or<\/p><p>(c) the appellant invokes significant new evidence relating to material facts or claims that arose after the first-instance examination.<\/p><p>The oral hearing may take place either in person or by videoconference, particularly where the appellant is detained, is subject to a border procedure, faces significant practical obstacles, or is an applicant with special procedural guarantees.<\/p><p>Where the appeal is examined through an oral hearing procedure, the Appeals Authority shall summon the appellant before the competent Independent Appeals Committee.<\/p><p>The appellant shall be informed, in a language that he or she understands, at least two (2) days before the hearing date in border procedure or accelerated procedure cases, and at least ten (10) days before the hearing date in all other cases, of data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>During the time limit for lodging an appeal and, where an appeal has been lodged within the prescribed time limit, until the decision on that appeal is notified, an applicant for international protection or a person whose international protection status has been withdrawn shall be allowed to remain on the territory of Greece, subject to paragraphs 2 and 3 of Article 68 of Regulation (EU) 2024\/1348.<\/p><p>Where an appeal is lodged, the applicant for international protection card shall be reissued, without prejudice to the application of the procedure laid down in Article 136 of Law 5307\/2026. Where an appeal is lodged out of time, an applicant for international protection card shall be issued only if the appellant\u2019s request to remain is granted, which shall be examined as a matter of absolute priority.<\/p><p>Where an appeal is lodged against a decision withdrawing international protection status, the appellant\u2019s residence permit shall be returned, provided that he or she has the right to remain in Greece in accordance with Article 68 of Regulation (EU) 2024\/1348.<\/p><p>The above right to remain shall not apply in cases where, pursuant to Article 68 of Regulation (EU) 2024\/1348 and Article 136 of Law 5307\/2026, the appeal does not have automatic suspensive effect. In such cases, and without prejudice to the principle of non-refoulement, the appellant\u2019s right to remain in Greece shall be decided by the Appeals Committee before which the appeal is pending, upon application by the person concerned. Such application shall be submitted within ten (10) days from the date on which the negative decision is notified to the person concerned. Pending the decision on such application, the applicant shall be allowed to remain on the territory of Greece, subject to paragraph 6 of Article 68 of Regulation (EU) 2024\/1348.<\/p><p>In the case of subsequent applications, and without prejudice to the principle of non-refoulement, the applicant shall not have the right to remain on the territory of Greece where the appeal is considered to have been lodged solely for the purpose of delaying or preventing the enforcement of a return decision (Article 136(4) of Law 5307\/2026).<\/p><p>The lodging of an application for annulment against a decision of the Appeals Committee shall not automatically confer a right to remain on the territory of Greece (Article 136(5) of Law 5307\/2026).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-inner-column elementor-element
